Your Terms, Explained

1. Introduction and Acceptance

Welcome to ServiGo, a platform operated by Kher & Dodiya Private Limited ("Company", "we", "us", "our"). By using the ServiGo mobile application ("App" or "Platform"), you ("you", "your", "User") agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the App.

These Terms, along with our Privacy Policy, form a legally binding agreement. By merely using/accessing the Platform, you signify your acceptance and create a legally binding agreement to abide by the same.

2. Eligibility

• You must be at least 18 years old to use this App.
• You represent that you are legally competent to enter into a binding contract.
• If you are under 18, you may only use the App with the express consent and supervision of a parent or legal guardian.

3. Description of Service

ServiGo is an online marketplace and service platform that connects customers ("Customers") with verified service professionals ("Vendors" or "Service Providers") for home appliance repair, maintenance, and related services. The Company acts as a facilitator, enabling transactions between Customers and Vendors. The Company is not a party to the actual service contract between the Customer and Vendor.

4. User Accounts

• To access the Services, you may be required to register and create an account.
• You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You agree to provide accurate and complete information and to update it promptly.

5. User Conduct

You agree to use the Platform only for lawful purposes. You shall not:

• Post or transmit any content that is unlawful, defamatory, obscene, or otherwise objectionable.
• Harass, threaten, or intimidate any Vendor or other user.
• Use the Platform for any fraudulent purposes.
• Interfere with or disrupt the security or functionality of the Platform.
• Infringe upon the intellectual property rights of the Company or any third party.

6. Bookings and Payments

• Service Booking: By booking a service, you agree to pay the price displayed for that service.
• Payments: All payments are processed through our third-party payment gateway, Razorpay. You agree to be bound by their terms and conditions.
• Cancellations and Refunds: Cancellation and refund policies will be displayed at the time of booking. We reserve the right to modify these policies in our sole discretion.
• Platform Commission: The Company charges a commission to the Vendor for services booked through the Platform. This does not affect the price you pay.

7. Vendor Disclaimer

The Company does not itself provide repair services. All services are performed by independent Vendors. We do not guarantee the quality, safety, or legality of any services provided by Vendors. Your relationship with a Vendor is a direct contractual relationship, and the Company is not liable for any disputes arising between you and a Vendor.

8. Intellectual Property

• All content, trademarks, and technology on the Platform are owned by the Company or its licensors and are protected by Indian and international intellectual property laws.
• The content is provided for your personal, non-commercial use. You may not copy, modify, or distribute any content from the Platform without our prior written consent.

9. Disclaimer of Warranties

The Platform and the services are provided on an "as is" and "as available" basis without warranties of any kind. We do not guarantee that the Platform will be error-free, secure, or uninterrupted.

10. Limitation of Liability

To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Platform or the services.

11. Indemnification

You agree to indemnify and hold harmless the Company, its directors, employees, and agents from any claims, losses, or damages arising out of your breach of these Terms or your use of the Platform.

12. Termination

We may suspend or terminate your access to the Platform at any time, with or without notice, for any reason, including for violation of these Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of India. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Surat, India. We may, at our discretion, resolve disputes through arbitration in accordance with the Arbitration and Conciliation Act, 1996.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Any changes will be posted in the App. By continuing to use the App after the changes are posted, you accept the updated Terms.
